TERMS AND CONDITIONS OF SALE
The present conditions of sale on the site are concluded :
- on the one hand by the company 3032 Oü with a capital of 2,500 euros, whose registered office is at: Sakala tn 7-2, 10141 Tallinn, Estonia, registered in the Trade and Companies Register under number 14917972.
- and on the other hand, by any legal entity wishing to make a purchase via the 3032 website, hereinafter referred to as "the buyer".
Subject
The present conditions of sale aim to define the contractual relations between 3032 and the purchaser and the conditions applicable to all purchases made through the 3032 merchant site.
The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or special conditions not expressly approved by 3032.
3032 reserves the right to modify its conditions of sale at any time.
In this case, the applicable conditions will be those in force at the date of the order by the purchaser.
Characteristics of goods and services offered
The products and services offered are those listed in the catalog published on the 3032 website WEBSHOP.3032.EU.
These products and services are offered within the limits of available stocks and are intended for communication professionals who have the knowledge and technical capacity to use them.
Each product is accompanied by a description of its characteristics.
The photographs in the catalog are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly with regard to colors.
Price list
The prices shown in the catalog are exclusive of VAT in euros and do not include VAT applicable on the date of the order. Any change in the rate may be reflected in the price of the products or services.
3032 reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the purchaser.
The prices indicated do not include the costs of order processing, transport and delivery, insofar as these take place in the geographical zones specified below.
Minimum order
We only accept orders of €500 or more, excluding VAT.
Under certain conditions and by way of exception, certain orders may be accepted subject to a handling fee of €50 excluding VAT.
Order processing
Orders are processed exclusively by email during our opening hours on working days from 8:30 am to 4:30 pm.
Outside these hours, or in case of saturation of our services due to a large influx of orders to be processed, we will not be able to process them the same day.
We do not process quotations or orders by telephone.
Orders are processed and validated before 12:00 noon.
If an order is received at 2:00 pm, for example, it will be processed the following day.
Stock
We make every effort to keep our product sheets up to date.
If a product is out of stock, the customer will be notified by email and offered a similar product.
If no similar product is available, the customer may request a refund.
As stock levels are purely indicative, for urgent orders we advise customers to contact our sales department in advance by email.
Geographical area
The online sale of products and services presented in the site is reserved for buyers residing in Europe.
Orders
The buyer, who wishes to buy a product or a service must obligatorily :
- be a professional registered with the RCS, a legal entity or a public body (the services offered by 3032 are not accessible to private individuals), and have an intra-Community VAT number;
- fill in the identification form, giving all the contact details requested, or provide your customer number if you have one;
- fill in the on-line order form, giving all the references of the products or services chosen;
- validate the order after checking it;
- make the payment in accordance with the conditions laid down;
- confirm the order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke the customer's own terms and conditions of purchase or any other terms and conditions.
All data supplied and the recorded confirmation shall be deemed proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out.
The seller will send confirmation of the registered order by e-mail.
Delivery times
Delivery times are expressed in working days and for all orders validated (payment and file ready to print) before 12:00 pm.
Withdrawal / Returns / Cancellation
Since products are personalized by the customer, cancellations are not possible.
Exceptionally, we can accept a cancellation before printing or personalization.
A handling fee of 10% of the value of the product, with a minimum of €50 excluding VAT, will then be applied.
In the case of unpacked goods or damaged products and packaging, a charge may be made for repairing or repackaging the product.
An administrative fee of €50 (excl. VAT) will also be charged in the event of cancellation before production or delivery.
Terms of payment
Payment is due at the time of order.
Payment may be made by :
- bank transfer,
- CB.
Orders will only be dispatched once payment has been confirmed by our bank.
The same applies to the printing of personalized products.
Order cancellation
The customer may cancel an online order after payment and before it goes into production: this will generate a credit note which will be available for a future online order.
NB:
- For all requests for reimbursement of orders under €1,500, a flat-rate penalty/management fee of €25 will be deducted.
- For all requests for reimbursement of orders over €1,500, a flat-rate penalty/management fee of €50 will be deducted.
Deliveries
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area.
The risks are borne by the purchaser from the moment the products leave the premises of 3032.
In the event of damage in transit, a justified protest must be made directly to the carrier on delivery.
Each package must be checked in the presence of the carrier in order to make any necessary reservations.
In the event of damage, the customer must contact customer service (during opening hours) by e-mail within 24 hours to inform them of the problem encountered during delivery.
A precise description of the damage and photos must be attached to this request. Without this and after the 24-hour period, no after-sales claim will be accepted.
Delivery times are given as an indication only; if they exceed thirty days from the order date, the sales contract may be cancelled and the purchaser reimbursed.
3032 cannot be held responsible for any delay in delivery.
These are beyond our control. We invite our customers to always allow an extra margin for delivery times in the event of delays (transport problems, snowfall, industrial action, etc.).
Warranty
All products supplied by the seller are covered by the legal warranty stipulated in articles 1641 et seq. of the French Civil Code.
In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or refund it.
Products printed or personalized to order cannot be taken back, exchanged or reimbursed.
All claims, requests for exchange or refund must be made by email within thirty days of delivery via email or our contact form.
In the event of a problem with an order, customer service must be contacted within one day by email and a registered letter sent.
No returns will be accepted without the approval of the sales department, which will provide the customer with a returns number and the address of our logistics platform. In the event of a return without having followed this procedure, the parcel will be considered lost by our logistics department and the customer will not be entitled to any reimbursement or compensation.
Liability
The seller, in the online sales process, is bound only by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, disruption of service, or other involuntary problems.
Intellectual property rights
All elements of the 3032 site (WEBSHOP.3032.EU) are and remain the exclusive intellectual property of 3032.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.
Any simple link or hypertext link is strictly forbidden without the express written consent of 3032.
Personal data
In accordance with the French Data Protection Act of January 6, 1978, personal data relating to purchasers may be processed automatically.
3032 reserves the right to collect information on purchasers, including by using cookies, and, if it so wishes, to transmit the information collected to commercial partners.
Purchasers may object to the disclosure of their contact details by notifying 3032. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of site users' e-mail addresses, was the subject of a declaration to the CNIL on (in progress), registered under number (in progress).
Archiving - Proof
3032 will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.
The computerized records of 3032 will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Reservation of ownership
Reservation of ownership clause: the seller retains full ownership of the goods sold until full payment of the price, in application of the law of May 12 1980.
Settlement of disputes
The present online sales conditions are subject to Estonian law and European provisions.
In the event of a dispute, the competent courts of Tallinn shall have jurisdiction, notwithstanding multiple defendants or third parties.
